Terms and Conditions

By signing this registration form, you agree to the following terms and conditions of registration as Real Estate Consultant with Arif Habib Development and Engineering Consultants. You agree and accept that Arif Habib Development and Engineering Consultants may change, suspend, or modify these terms and conditions at any time without prior notice at its sole discretion. You further agree that in case of any dispute in this regard, the decision of Head of Sales department of Arif Habib Development and Engineering Consultants shall be final and binding upon you.

  1. You are hereby appointed as Real Estate Consultant to market, promote and facilitate the sale of the properties / products of Arif Habib Development and Engineering Consultants.
  2. You will follow the instructions, guidelines, and advice of Arif Habib Development and Engineering Consultants in respect of above activities.
  3. You will not receive/collect money on behalf of Arif Habib Development and Engineering Consultants.
  4. You will never represent yourself as employee of Arif Habib Development and Engineering Consultants.
  5. You will work in the best interest of Arif Habib Development and Engineering Consultants and in all dealings act honestly and faithfully.
  6. You will refer the prospective customer to Sales Centre and in this regard follow the Arif Habib's sales procedure attached herewith.
  7. In the event customer is referred to Arif Habib Development and Engineering Consultants by two or more different REC's simultaneously, Arif Habib will pay the commission to such REC as designated by the customer in Customer Acknowledgment Letter ("CAL") at the time of sale purchase agreement for the property is signed.
  8. All commission payments will be paid to you as per Annexure -A subject to the sale of property and receipt of down payment of the purchase price of property.
  9. Commission will not be paid in case of any violation of Arif Habib's sale procedure by you.
  10. No commission shall be paid on upgrade or change of property sold.
  11. This registration is valid for 01 year and shall be renewed automatically unless terminated through prior notice by Arif Habib Development and Engineering Consultants. Arif Habib Development and Engineering Consultants reserves the right to cancel/terminate your appointment for any reason whatsoever.
  12. Upon termination, any amount due to you shall be calculated and paid by Arif Habib Development and Engineering Consultants at its sole discretion.
  13. Arif Habib Development and Engineering Consultants shall also reserve the right to recover from REC any commissions previously paid to the REC, that do not comply with the requirements specified above.

Commission Invoice Submission

When claiming for commission, the REC shall, within 14 days after the commission becomes due, send to Sales Center an invoice with all supporting documents showing the aggregate net price of each of property sold through reference of the REC at Sales Centre, or any other address as intimated by Arif Habib Development and Engineering Consultants. REC shall ensure that the following document is attached along with the original invoice for processing of commissions:

Duly signed original CAL (Customer Acknowledgement Letter).

Annexure-A

Commission Eligibility

a) Cancellation by customer: Commission shall not be paid in case of default by the customer before 20% payment is received. In such cases all pending commissions to be paid to the REC shall be withheld at the sole discretion of Arif Habib Development and Engineering Consultants.

b) Property Upgrade: If the property is upgraded before payment of commission to REC, the commission shall be based on upgraded unit price of the property.

c) Property Downgrade: For subsequent downgrade of property by customer introduced by the REC and before payment of commission, commission shall be based on the downgraded unit price of the property.

d) Commission Entitlement, Claim Submission and Payments: Sales commission shall be paid to the REC for the sale of property to the customer referred by the REC. The name of the REC shall be entered in the booking form and customer must acknowledge it on CAL (Customer Acknowledgement Letter).

e) Compliance with Anti-Money Laundering: The REC shall ensure that they are compliant with Anti-Money Laundering laws, regulations, notifications (as amended from time to time). The REC indemnifies Arif Habib Development and Engineering Consultants against any risks associated with its non-compliance of the foregoing laws.

Important Notice: The Commission Rates are subject to change any time upon the discretion of the Management of Arif Habib Development and Engineering Consultants.

Recommendation

It is therefore recommended that the approval may please be granted for (REC Name: _____________ CNIC #: _____________), to be registered as a REC with Arif Habib Development and Engineering Consultants.

Notes:

  1. Any arrangements for commission between client and the agent are strictly conducted and executed by the two parties at their own discretion without AHDEC's commitment.
  2. Two CAL copies must be signed by all parties, one to be submitted to AHDEC and one for the Real Estate Agent to be submitted to AHDEC at the time of commission claiming.
  3. The signature(s) and name(s) of the client(s) must match the signature(s) and name(s) on the sales agreement.
  4. In case of joint buyers, both buyers must sign Customer acknowledgment letter.
